The Court of Appeal concluded that the two Class Members cannot bring the appeal and, in the result, ordered that the appeal file be closed.  This means that the Court of Appeal will not set aside the Settlement Approval Order. 

Before the settlement can be implemented as approved by Justice McDonald, we must respect the timeframe within which the appellants can seek leave to appeal to the Supreme Court of Canada.  If they do not seek the opportunity to commence a further appeal to the Supreme Court, the Claims Period can then open immediately.  We will know the answer by mid-October, and we will provide any further updates as soon as they are available.
